Licenses, Taxes and Agent Portals
This Regulation establishes the legal framework governing the exploration, production, purchase, refining, storage, transportation, export, and commercialization of gold and precious metals within the Republic of Niger.
The objectives are to:

strengthen national sovereignty over mineral resources;

combat illicit trade and smuggling;

formalize artisanal and industrial mining activities;
-
enhance fiscal revenues;
-
ensure traceability and transparency of precious metals;
Apply for a Miner and/or Producer License:
ASM – Artisanal Small Miner License
MML – Medium Miner License
LML – Large Miner License
The Buyer & Aggregator licensing system is one of the most important mechanisms in the regulation of the gold sector.
Its objective is to:

formalize gold trading;
-
prevent smuggling and illicit exports;
-
ensure traceability of gold production;
-
protect artisanal miners from illegal purchasing networks;
-
centralize fiscal and customs control;
-
guarantee that gold reaches official refining and export channels.
This system creates a controlled chain between:
Miner / Importer → Buyer → Aggregator → Refinery → Export
Without this structure, gold frequently leaves the country through informal and illegal networks.

Applies to storage, vaulting, collateral management, and transport security facilities for Gold and any Precious Metals in Niger.

Certified security systems;

Insurance coverage;

Real-time inventory reporting capability.

Granted to entities authorized to refine gold and precious metals in Niger.

Industrial operating permit;
-
Security and surveillance systems;
-
Assay laboratory certification;

Environmental approvals.
Obligations
-
Maintain full traceability records;
-
Report all refined quantities to authorities;
-
Prioritize legal domestic production channels.
Strategic Provision
The State may designate refining activities as strategic national infrastructure.

Required for manufacturing and commercial sale of gold jewelry. Not regulated under this document.

Source gold from licensed channels only;

Use certified purity standards;

Maintain transaction records.

COMMON DOCUMENTATION FOR APPLICATIONS
1. Government and Company Registration Requirements
Applicants shall provide:

Certificate of incorporation;
-
Tax registration;
-
Shareholder disclosure;
-
Identification of beneficial owners;
-
Criminal background declarations;
2. Financial Requirements
Applicants shall demonstrate:
-
Minimum capital requirements;
-
Proof of financial solvency;
-
Banking references;
-
Source of funds declarations.

Proposal for strategic Role. Only customs agents accredited by the Ministry of Mines and Customs Authority may process precious metal exports.

AML/CFT compliance training;

Secure logistics capability;

Digital reporting connectivity.
2. Obligations
-
Ensure accurate export declarations;
-
Cooperate with refinery and customs inspections.
3. Custom Agent main activities & responsibilities:
-
Direct interaction with Miner, Producers, Buyers and Aggregator Licenses.

An Agent must be identified in every IMPORT / EXPORT Tax Operation.

An Agent is eligible to approve Collateral Management for advanced TAX Payment System.
-
An Agent must be identified in any border operation of IMPORT Gold from any 3PP Country to the National Niger Refinery.

An Agent must be identified in any TRANSIT from border to the National Niger Refinery. Therefore an Agent is involved in ant IMPORT / EXPORT gold Operation.
Agent Application
Custom Agent Application, as public Employee, is defined under Ministry of Mines Scope.
